Public procurement represents approximately 13.5% of GDP in the Czech Republic (also known as Czechia) and covers all sectors. Due to its size and budget, the public sector is an important partner for most companies.

Procurement Law

The new Act on public procurement - 134/2016 Coll. - became effective on October 1, 2016. This Act implements the relevant legislation of the European Union. The main purpose is to ensure free and open competition between suppliers and also execution of tender selection in a transparent manner without discriminating against bidders. More information about public procurement in the Czech Republic can be found on the website of the Ministry of Regional Development.

Publication of tenders is extremely scattered due to a law that obliges all awarding authorities to have their own authority profile. Especially small-value tenders, i.e. tenders with an estimated contract value below CZK 3 million (or approx. EUR 120,000) for goods and services and below CZK 9 million for works (= around EUR 360,000), are often published authority profiles only.

Participating as a foreign company

Czech Republic has one of the least competitive markets for public procurement across Europe: more than 48% of tenders have only one bidder, according to both ECA dashboard and EC Single Market scoreboard. Also the average number of bids of only 2.6 indicates that there is limited domestic competition, allowing for foreign companies to fill the gap.
