In essence, Law on Purchases and Contracting of Goods, Services, Works and Concessions of the Dominican State provides extensive protection to local distributors upon termination, and it mandates that at least 66% of the capital must be locally owned. Despite the existence of Law 42/08 and the Competition Commission, the market encounters significant competition barriers. Public entities frequently breach contracts and fail to make payments, resulting in projects being suspended for prolonged periods due to funding shortages or political instability. Non-payment or partial payment for works and services is common. Additionally, the tight deadlines of tenders and their classification as "national" often prompt many participants to withdraw.
